We, MWELT LIMITED, Registration number: 15888300, registered at Suite 1, 46 Dorset Street, London, United Kingdom, W1U 7NB ("we", "us" and "our") offers a range of different services through its software, including, but not limited to, "NFL Quiz" / "American Football Quiz". The terms of this document govern your use of the Services.
These Terms & Conditions (the "Terms") along with our policies and other relevant documents published at https://ctrlweb.app/nfl-quiz/, form a legally binding contract between you as the "User" and us.
By using our services (as defined below), you as the User are hereby explicitly agreeing and consenting to be bound by these Terms. Disagreement with any clause necessitates immediate cessation of use.
Documentation - refers to our standard technical documents, game rules, and materials that come with the Services. They include guides and other information meant to help you use our Services.
Services - refers to the different services we offer to you from time to time. These include our mobile trivia application "NFL Quiz" ("American Football Quiz"), Single-Player quizzes, With Friends multiplayer challenges, Special Games, Logos and Trivia categories, Player Rankings leaderboards, and related services. You can access these Services using any current or future device or technology.
Software - refers to the software products we have created and provide, including our mobile application "NFL Quiz" ("American Football Quiz"), which is available only in object code format. This also includes any updates or upgrades we provide. However, it does not include any third-party software that might be used or included with our products.
Third-Party Software - refers to software products developed by external parties that may be included with or used alongside our Software. Since these parts are made by others, we don't control or develop them.
Use - means interacting with our Software by running its programs on your device according to the instructions in the Documentation. It covers all actions related to operating, playing, interacting with, or utilizing the Software as described in the Documentation.
User - you, a person who is at least 18 years old, who downloads or uses our Services.
You understand that our Services and Software, including their original design, code, question compilations, and documentation, are valuable and protected by intellectual property laws. While we give you a license to use them as described below, we and our suppliers still own all rights to the Software and related materials. None of the provisions within these Terms shall insinuate the transfer of ownership rights to our Software.
All team names, league names, logos, helmets, and player names referenced within trivia questions are the property of their respective owners and are used strictly for descriptive, educational, and informational trivia purposes. "NFL Quiz" ("American Football Quiz") is an independent trivia application published by MWELT LIMITED and is not affiliated with, endorsed by, or sponsored by the National Football League (NFL), NCAA, or any professional or collegiate football franchise.
If you agree to these Terms, we give you a limited, non-exclusive, and non-transferable license to install and use our Software and Services on your personal device. You agree not to do the following, and not to let anyone else do them:
Access to Services: We provide you with access to interactive sports quizzes, Special Games, Logos, Trivia, Player Rankings, and profile management features. You agree to use our Services responsibly, select appropriate player nicknames, and comply with all applicable laws and regulations. Do not use the Services for any illegal activities, cheating, automated scraping, or to infringe on others' rights. Misuse of the Services or violation of these Terms may result in suspension or termination of your access to our Services.
Changes to Services: We may change, pause, or stop any of our Services at any time. This includes modifying, suspending, or discontinuing quiz categories, coin balances, leaderboards, or the Services completely or partially, without prior notice. You agree that we will not be liable to you or any third party for these changes.
Export Control: You agree to follow all relevant export control laws and regulations when using our Software and Services.
Software or services developed and provided by third parties are subject exclusively to the licensing terms, conditions, and policies established by those third parties. We disclaim any responsibility or liability for the performance, functionality, or any issues arising from the use of third-party software or services.
Our Software includes a virtual in-game currency ("Coins" or gold football coins) earned through gameplay (such as answering questions in 10-question rounds) or optional promotional features. Coins may be used within the Software to unlock Special Games (including Super Bowl History for 50 coins, Legends & Hall of Fame for 100 coins, and Retro Logos for 200 coins) or in-game lifelines (Hint and Skip).
Virtual Coins have no real-world monetary value, cannot be exchanged for cash or legal tender, and are non-transferable between users or applications. We reserve the right to manage, regulate, control, modify, or eliminate Virtual Coins at any time without liability to you.
Our Software may offer both free gameplay (including offline play across 202 questions and 10 topics) and optional in-app features or advertisements from our partners.
ALL USE OF THE SERVICES AND ANY CONTENT IS UNDERTAKEN ENTIRELY AT YOUR OWN RISK. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" AND ARE WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED.
In no case will our company or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever including, without limitation, damages for loss of use, data, or profits, related to the use or performance of our Services and Software. We are also not liable for any direct damages in excess (in the aggregate) of the amount you paid for the Service or $500, whichever is higher. If you are not satisfied with our Services or the Terms, your only option is to stop using them.
You agree to protect and hold our company, its affiliates, and employees harmless from any claims or damages, including reasonable legal fees, that arise from your use of our Services and Software or your conduct while using them.
Use of the Software is also governed by our Privacy Policy and Cookie Policy. By using our Services, you consent to the collection and use of data as outlined therein.
Governing Law and Jurisdiction: These Terms are governed by the laws of England and Wales. Any disputes related to these Terms, or your use of our Services must be resolved in the courts of England and Wales.
Severability: These Terms are the complete agreement between you and our company regarding the Services, replacing any previous communications or proposals. If any part of these Terms is found to be invalid or unenforceable, the rest will still apply.
Modifications: We may assign, transfer or delegate any of our rights and obligations without needing your approval. We may update these Terms occasionally. It's your responsibility to stay updated, as you must follow the latest Terms.
Termination: We can end your access to the Service at any time if you don't follow these Terms, which might cause you to lose all in-app progress and virtual coins. Please keep in mind that any fees you've paid are non-refundable.
